New Law on Public Contracts shall enter into force in Angola

The new Law on Public Procurement Angola, repealing the old Law on Public Procurement came into force last Friday, informed the Angolan Ministry of Finance.

The statute seeks to defend the rationalization and reduction and control of public spending, and has the new express consecration of the simplified procurement procedure for low-value procurement, as well as to material situations that justify the adoption of a procedure not a public tender.

The Ministry of Finance, in its statement, clarifies the difference between the tender and restricted tender with pre-qualification, and states that the proposal will eliminate the qualifying round of the public tender.

The statement said that the statute also eliminates the negotiation procedure, but at the same time enshrining the right of the public authority contractor can enter in any public procurement procedure a phase of negotiation of the proposals.

Another phase also eliminated is the special procedure called “Systems of electronic dynamic acquisition”, as the national and international practice revealed that had almost no use.

Were also weighted by the legislator other aspects such as the elimination of the special procedure for the procurement of consulting services and the establishment of a new system dedicated to framework agreements as special procurement instruments, in law enforcement that also incorporates the enforcement regime contracts for works, goods and services.
